Asshole Of The Day
"Joe The Plumber", Asshole of the Day for May 27, 2014

Joe The Plumber, made famous by John McCain during a debate in 2008, is neither plumber nor named Joe. But Joe has enjoyed the spotlight that resulted from that mention, and even ran for Congress and lost.
But he still likes to keep his name out there commenting on things, and when all those people were killed at UCSB over the weekend, he spoke right up :

I am sorry you lost your child. I myself have a son and daughter and the one thing I never want to go through, is what you are going through now. But:
As harsh as this sounds – your dead kids don’t trump my Constitutional rights.

Now Joe The Plumber is correct that the current way that the NRA and Republican party interpret the 2nd Amendment, and in many ways validated by the 5 Republicans on the Supreme Court, is that dead kids don’t matter and gun rights are unlimited and inviolable. To the NRA and their supporters no amount of dead kids— one school full, two schools full, or even hundreds of thousands of children— can limit gun rights.
But here’s the thing— this is a new interpretation of the 2nd Amendment. Prior to 1991 gun rights were understood that states were allowed to make laws against, even if the federal government was restricted. And even then, the federal government was allowed to put limitations, but not take away all guns. Former Supreme Court Justice John Paul Stevens explains:

Concern that a national standing army might pose a threat to the security of the separate states led to the adoption of the Second Amendment, which provides that “a well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.”
For more than 200 years following the adoption of that amendment, federal judges uniformly understood that the right protected by that text was limited in two ways: First, it applied only to keeping and bearing arms for military purposes, and second, while it limited the power of the federal government, it did not impose any limit whatsoever on the power of states or local governments to regulate the ownership or use of firearms. Thus, in United States v. Miller, decided in 1939, the court unanimously held that Congress could prohibit the possession of a sawed-off shotgun because that sort of weapon had no reasonable relation to the preservation or efficiency of a “well regulated Militia.”

And this is important to remember. The NRA wasn’t always this way. The 2nd Amendment wasn’t always understood to be an unlimited and unrestricted right. The idea that citizens were allowed to stroll into a business and wave their guns around, as the Open Carry people do, was never allowed prior to the last several years. Not in Revolutionary times, not in the antebellum South, not in the Wild West. Not ever.
Alcohol, Tobacco and Firearms has their own department in the government and goes back to 1886, which means that the idea that guns should be regulated isn’t a new one. So let’s not pretend the 2nd Amendment was handed from Jesus to Thomas Jefferson and then written down, and then only violated by Presidents Clinton and Obama.
It is the current interpretation of the 2nd Amendment which is ahistorical. And hopefully for America’s sake, there will be a point at which the number of dead children pushes people into insisting on the original understanding of the 2nd Amendment, and that there will therefore be an end to the pointless slaughter allowed in the name of unlimited gun rights.
And most of all let’s just remember that the 2nd Amendment specifies gun rights tied to a “well-regulated militia”, and that’s just not true here, as a satirized earlier:

Joe The Plumber: “Your dead kids don’t trump my constitutional right to own guns even though I’m not in a militia, regulated or otherwise.”

So, for saying “your dead kids don’t trump my Constitutional rights”, Joe The Plumber is the Asshole of the Day.
It is Joe The Plumber's first time as Asshole of the Day, but one of many speaking about gun rights or the 2nd Amendment.
